According to Bloomberg Businessweek, a Texas jury recently ruled against TVT-O maker Johnson & Johnson. The jury ordered J&J to pay the plaintiff $1.2 million in damages for TVT-O mesh sling injuries. Plaintiff Blames TVT-O Design Defects for Chronic Pelvic Pain
Plaintiff 64-year-old Linda Batiste allegedly suffered pelvic pain after J&J’s TVT-O mesh sling eroded. Ring of Fire Radio reported the settlement showcases how corporate negligence can put consumers’ health at risk. However, women who have experienced transvaginal mesh injuries and pain from their implants can still bring to light these issues and make corporations accountable for their actions.
However, Bloomberg Businessweek reported the jury did not accept Batiste’s claims that the company lacked warnings on the risks associated with its transvaginal mesh devices. Batiste was not rewarded punitive damages, according to the news source, only compensation for her suffering.
The TVT-O device is still available to consumers, Bloomberg Businessweek reported. In addition, J&J stated it will appeal this ruling.
Matthew Johnson, spokesman for J&J’s Ethicon division, issued an email stating the company believes it can successfully overturn the ruling.
“The jury’s verdict on design defect is disappointing, and we believe we have strong grounds for appeal,” Johnson said.
While Bloomberg Businessweek reported J&J still currently has more than 12,000 additional lawsuits pending against it, this case highlights how one woman seeking damages for her pain can win against a large corporation.
