An order from Sept. 18, 2014 from the the U.S. District Court, Southern District of West Virginia, stated that a consolidated bellwether trial is scheduled for Nov. 3, 2014 in the the middle district of Florida. This case will involve five mesh lawsuits, and a pre-trial conference will be held on Oct. 23.
“Bellwether trials are important in large litigations, as they may provide clues to jury rulings in similar cases, ” a law firm representing TVM plaintiffs said in a statement.
Currently, there are more than 13,000 suits filed against Boston Scientific in West Virginia by women who claimed to have suffered serious complications due to transvaginal mesh made by this company. Additionally, there are more than 60,000 cases filed against multiple manufacturers.
What’s Next for TVM Litigation
The first trials in the federal litigation have not yet started, but a state court in Texas ordered Boston Scientific to pay a woman more than $73 million in punitive and compensatory damages because of a defective product design and a failure to sufficiently warn doctors and patients about possible associated risks.
